At HMI, we are committed to maintaining a safer space for LGBTQIA+ youth. If Immigration and Customs Enforcement (ICE) attempts to enter our space, it’s essential to understand your rights and our policies.
ICE Access to HMI’s Space
HMI is committed to maintaining a safer space for LGBTQIA+ youth. If ICE attempts to enter, strict legal requirements must be met.
- ICE must have a judicial warrant to enter non-public areas.
- The warrant must be signed by a judge within 14 days prior to the incident.
- It must specify the individual suspected of violating civil immigration law, a violent or serious crime, or being on the terrorist watch list.
- It must clearly identify the area they intend to search.
- HMI’s space is non-public, with the exception of reception areas.
- Schools are protected areas, meaning ICE agents must go through supervisory review before entering.
- Administrative warrants do NOT grant ICE access. HMI can lawfully deny entry if presented with an administrative warrant.
Your Rights If ICE Presents a Judicial Warrant
If ICE presents a valid judicial warrant, you still have rights and protections. Here’s what you need to know.
- You have the right to contact legal counsel before answering any questions.
- ICE cannot interfere with or disrupt HMI’s mission or activities.
- Uniforms may say “Police”, but even law enforcement needs a judicial warrant to enter.
